Issuing a bad check is a serious crime in Virginia. A person accused of issuing a bad check of more than $200 may be charged with a Class 6 felony, punishable by a term of imprisonment of up to five years. A person accused of issuing a bad check of less than $200 may be charged with a Class one misdemeanor, punishable by confinement in jail of up to one year (VA Criminal Code 18.2-181).
In order to obtain a conviction for passing a bad check, the prosecution must establish intent. If you simply failed to properly balance your checking account or made an error, you are not guilty of a criminal offense.

Virginia criminal code 18.2-181.1 creates serious penalties for anyone who issues two bad checks within a 90 day period. Pursuant to the Code, such action constitutes a Class 6 felony if the checks are drawn from the same accounts, are made out to the same party and have a combined value of $200 or more.
