- $1,000 fine
Third Offense Breath Test Refusal
If you have two prior DUIs, two prior breath test refusals or one of each, and then refuse to take a breath test, you will face:
- Three-year suspension of your driver's license, with no opportunity to obtain a restricted license
- Up to 12 months in jail
- $2,500 fine
All driver's license suspensions for refusal to submit to a breath test are in addition to any suspension stemming from a DUI conviction. These suspensions run consecutively.
