Federal Implied Consent Law
If you are stopped on federal property for drunk driving, you are subject to the federal implied consent law. That means you must submit to a breath or blood test. Depending on your prior record, refusal to submit to these tests will result in suspension of your driving privileges and may result in time in a federal prison, a fine or both.
The specific penalties for federal DUI/DWI vary depending on whether you were arrested on land owned by the National Park Service or by another unit of the federal government. For example, drinking and driving on land owned by the National Park Service is considered a Class B misdemeanor and can carry up to $5,000 in fines and six months in prison.
Aggressive Federal DUI/DWI Defense
Our attorneys will carefully investigate your DUI/DWI stop, including the arrest, the field testing and the blood alcohol test. Rest assured, they will do everything possible to fight your conviction.
